The ownership and operation rights of babemotion, the infant activity monitoring device, belong exclusively to iLece Op Co., Limited (hereinafter referred to as “iLece” or the “Company”).
This User Service Agreement (hereinafter referred to as the “Agreement”) is entered into between the user of babemotion (hereinafter referred to as the “User”) and iLece regarding the rights and obligations related to various application services provided by babemotion.
By agreeing to all terms of this Agreement and completing the entire device binding process according to the prompts on the babemotion device binding page, the User fully accepts all terms under this Agreement. Clicking the “Agree” button during the device binding process indicates that the User has completely accepted all terms herein. If you do not agree to the terms of this Agreement, please do not bind the device or use the related services.
iLece reserves the right to modify the terms of this Agreement at any time. Once published, the modified Agreement shall immediately replace the previous version. Users may review the latest version of the Agreement at any time.
I. Service Content
When Users purchase and use the Company’s health devices, they must download and install babemotion on a smart mobile terminal (such as a mobile phone or tablet) to bind the health device with the smart mobile terminal. babemotion uploads the User’s health data to the User Data Center for storage. babemotion may continuously update its application services and provide the latest version to the User’s smart mobile terminal.
Once you successfully bind a device and become a User, you are fully responsible for all activities and events under your account. If your personal information falls outside your control due to your negligence, you shall bear full responsibility for any resulting damages caused to yourself, iLece, or any third party.
The User understands and agrees that babemotion only provides related application services. Devices related to such services (including but not limited to personal computers, mobile phones, and other internet-access devices) and all related expenses (including internet fees, mobile data charges, etc.) shall be borne solely by the User.
This product is not a medical device. The health data and recommendations provided are not intended for disease prevention, diagnosis, or treatment and are for reference purposes only.
II. User Rules
The User undertakes to register and use babemotion under their true identity and confirms that they are a natural person with full civil rights capacity and full civil conduct capacity. The User guarantees that all personal identity information and physiological information provided (such as gender, birthday, age, etc.) are true and valid. Any distortion in calculation results caused by inaccurate or false information provided by the User shall be solely borne by the User.
iLece shall not bear any responsibility for any loss or damage suffered by the User or any third party due to illegal use of the User’s account or password resulting from hacking or the User’s improper safekeeping.
The User shall be responsible for all actions conducted under their account. iLece shall not bear any responsibility for any loss or damage suffered by the User or any third party due to the User’s actions.
The User understands and agrees that advertisements may be included in babemotion application services and agrees that iLece and third-party suppliers or partners may display advertisements during service usage. The User also agrees that iLece may send promotional or other commercial information through WeChat notifications or other registered contact methods.
During use of babemotion application services, the User must comply with the following principles:
a) Comply with applicable laws and regulations of the People’s Republic of China;
b) Not use babemotion for any unlawful purpose;
c) Comply with all network protocols, regulations, and procedures related to babemotion services;
d) Not engage in any conduct that may adversely affect the normal operation of the internet through babemotion;
e) Not publish any harassing, defamatory, abusive, threatening, obscene, vulgar, or otherwise illegal information through babemotion;
f) Not engage in any conduct detrimental to iLece or babemotion;
g) Not infringe upon patents, copyrights, trademarks, reputation rights, or other lawful rights of iLece or any third party;
h) Use designated communication channels for inquiries regarding services, products, or business cooperation with iLece and its business partners, and refrain from publicly publishing negative statements regarding iLece or related application services;
i) Immediately notify iLece customer service upon discovering any illegal use or security vulnerability related to a User account;
j) Not use any method to attack service equipment such as User Data Center servers, illegally obtain or modify unauthorized data, interfere with normal babemotion services, or engage in any other harmful activities.
If the User violates any of the above provisions while using babemotion services, iLece or its authorized personnel shall have the right to require correction or directly take all necessary measures (including but not limited to modifying or deleting collected content, suspending or terminating the User’s access rights) to mitigate the impact caused by the improper conduct.
III. Service Modification, Interruption, or Termination
Due to the special nature of application services, the User agrees that iLece has the right to modify, interrupt, or terminate part or all of babemotion services at any time according to business development needs without prior notice and without liability to any User or third party.
The User understands that iLece may need to periodically or irregularly inspect or maintain platforms or equipment related to babemotion services (including internet websites or mobile networks). Any temporary interruption caused within a reasonable period due to such maintenance shall not result in liability for iLece, although iLece will attempt to provide advance notice whenever possible.
If the User violates any usage rules under this Agreement, iLece has the right to suspend or terminate babemotion services to the User at any time without liability to the User or any third party.
IV. Privacy Protection
Protecting User privacy has always been one of iLece’s fundamental policies.
iLece has the right to conduct technical analysis on the entire User database and commercially utilize analyzed and organized User database information. Although iLece makes substantial efforts to protect User privacy, existing security technologies cannot guarantee that technical information will not suffer any form of loss. Please refer to iLece’s “Privacy Policy.”
iLece may cooperate with third parties to provide related application services. In such cases, if the third party agrees to assume the same level of privacy protection obligations as iLece, iLece may provide User identity information and physiological information to such third parties.
Without User consent, iLece shall not disclose or share User registration information, including names, identification numbers, contact details, or addresses, except under the following circumstances:
k) Prior explicit authorization from the User or the User’s guardian;
l) Requirements under applicable laws and regulations;
m) Requests from relevant government authorities according to legal procedures;
n) When iLece initiates litigation or arbitration to protect its legitimate rights and interests;
o) To protect the public interest.
V. Intellectual Property Rights
All intellectual property rights related to babemotion and its application services, including software, text, sounds, images, graphics, charts, audio, video, and other content, belong to iLece and are protected by patent law, copyright law, trademark law, and other applicable laws and regulations. Without written authorization from iLece or relevant rights holders, no person may use, copy, modify, distribute, publicly issue, or publish any babemotion-related programs or content.
All rights related to any software used by babemotion to provide application services (including but not limited to images, photos, animations, videos, recordings, music, text, add-on programs, and accompanying help materials) belong to the software copyright holder. Without permission from the copyright holder, the User shall not reverse engineer, decompile, or disassemble such software.
VI. Disclaimer
iLece provides application services on an “as is” and “as available” basis. iLece makes no express or implied warranties regarding the applicability, error-free nature, continuity, accuracy, reliability, suitability for specific purposes, or other aspects of the application services. iLece also makes no guarantees regarding the validity, accuracy, correctness, reliability, quality, stability, completeness, or timeliness of related technologies and information. However, iLece shall perform its related application services diligently and in good faith.
iLece does not guarantee the accuracy or completeness of external links provided for User convenience and shall not bear responsibility for any content on webpages not actually controlled by iLece.
iLece shall not bear responsibility for service interruption, delays, User data loss, or other losses caused by telecommunications failures, internet failures, computer malfunctions, viruses, information corruption or loss, system problems, force majeure events, or other uncontrollable causes. However, iLece will make reasonable efforts to minimize resulting losses and impacts.
VII. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the People’s Republic of China.
Any dispute arising from or related to this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to the Shenzhen Arbitration Commission in accordance with its then-current arbitration rules. If arbitration cannot resolve the dispute, either party may file a lawsuit before the People’s Court having jurisdiction over iLece’s registered location.
VIII. Miscellaneous
If any provision of this Agreement is deemed wholly or partially invalid, unenforceable, or in violation of applicable law for any reason, such provision shall be deemed severed, while the remaining provisions shall remain valid and binding.
iLece reserves the right to modify this Agreement at any time according to changes in laws, regulations, business operations, or company strategies without separately notifying Users. The modified Agreement will be published on the iLece website (www.ilece.com). Users may review the latest terms at any time through the iLece website. In the event of any dispute, the latest version of the Agreement shall prevail. If the User does not agree to modifications made by iLece, the User has the right to stop using the services. Continued use of the services shall be deemed acceptance of the modified Agreement.
To the maximum extent permitted by law, iLece reserves the right of final interpretation and modification of this Agreement.
